Article 1 - Definitions :
Items : Products of all range sold on the website (e-commerce services)
Customer : The prospective purchaser of goods, services or both with respect to any contract or
contract right.
Order : Purchase commitment on all of the items selected by the customer via the e-commerce
service on our website.

Article 2 - Prelude :
Our general terms & conditions of sales are exclusively applicable between each customer and the
company YAZINA, headquartered in the 10 Rue de la Paix 75002 Paris, France - registered at the
Paris Trade & Companies Register under number 878 934 116.
The company has for legal object, in France and in all the countries subject to the required
administrative authorisations and in all limits of the regulations in effect : E-Commerce company
distributing the brand Moroccan Touch.

Our general terms & conditions of sales are applicable without restriction nor reserves on all of the
items for sale on our website.
Each purchase on the website www.moroccantouch.com will automatically involves your
agreement on our conditions, that the customer acknowledges reading prior to its order
confirmation.
Article 3 - Items characteristics :
The products available for sale are those who appears on the website. These are subject to stock
limits.

YAZINA commits to describe and present its products in the most precise and exact way possible.
YAZINA reserves the right to withdrawal products from sale on the website, or to modify
informations associated to the products featured on the website.
Inconveniences may occasionally occur regarding the availability of certain products, after
confirmation of order. In such circumstances, the customer will be informed by e-mail, and the
order will be automatically cancelled.
YAZINA commits to proceed to a refund without undue delay, with a maximum of 14 days after the
order’s cancellation.

Article 4 - Products orders :
Each order involves an obligated card debit payment, using a bank account with sufficient funds, or
via Paypal.
The order is confirmed as soon as the payment of the product and associated fees is complete.
All payments made on the website are assigned to a secure online payment platform.
The order is confirmed once the payment has been accepted by YAZINA, who engages in fulfilling
all of the orders received, limited to the stock available.
Article 5 - Prices of the products :
All of the prices presented on the website are in euros, inclusive of all taxes, excluding shipping
fees. The shipping costs are specified before the order validation.
YAZINA reserves the right to modify the product’s prices at any time, without notice.
The items are invoiced at the price in force at the time the order is received.
The products will remain wholly owned by YAZINA until acknowledge receipt of the sum due payed
by the customer.
Article 6 - Order’s payment :
All orders made on the website is definitive once the payment of the product’s price and the order
fees is completed.
Once the customer validated the order, he recognise and accepts the integrality of our general
terms and conditions of sales. The customer pays on the website www.moroccantouch.com

B. Payment verification
In order to assure your protection against some abusive hacking and fraud practices, YAZINA
controls all orders confirmed on the website.
As part of this control, our customer service may ask you some documents needed for your order
validation, such as a proof of residence in your name, or in the name of the person indicated for
the delivery address.

C. Secure payment

The payment is secure thanks to the online payment system of our partner Stripe.
Your bank details will be encrypted, which means they’ll be coded in a way that they are illegible on
the Internet.
Article 7 - Delivery :
Your orders are prepared then expedited as per the delivery mode and schedule set-out below.
The delivery time can be extended during a period of trading operations.

Country customs or import taxes might be added to the product prices for order outside the
European Union, and remain the responsibility of the customer. It is then the duty of the customer
to learn about their amount through their local customs office.

Article 8 - Returns & Exchanges :
A. Right of withdrawal
The customer has 14 days from the date of the order’s reception to cancel an order without
mentioning cause.

In order to exercise the right of withdrawal, the customer needs to notify this decision to YAZINA by
e-mail on the address moroccan touch.info@gmail.com, before the expiry of the withdrawal period,
through an unambiguous worded statement (sent by mail or e-mail).
If the customer choses this option, we would immediately respond by e-mail with an
acknowledgement of receipt of the withdrawal.
The customer must return the items not later than 14 days after notifying the withdrawal.
Only unworn and undamaged items will be refunded. The items must be returned in their original
packagings (or in a packaging ensuring equal protection) with the garment label.
The returns are conducted by post.
B. Modalities of Returns
Returns must be made by post. Once the returned items are inspected and verified, YAZINA
undertake to send a refund to the customer as soon as possible after notice of withdrawal.
In case of non-reception of the items concerned or of an expedition proof in this delay, YAZINA
reserves the right to postpone the refund until the items or the expedition proofs are received.
Products purchased during online sales periods would not be returned.
The entirety of the amount spent on the item concerned and on the shipping fee would be refunded
to the customer (apart from special extra fees such as a faster delivery method).
The customer would receive a confirmation e-mail as soon as the refund would be sent.
Article 9 - Legal Guarantee :
All products sold on www.moroccantouch.com are subject to a contractual guarantee of conformity,
set out in articles L. 217-4 following the French Consumer Code, and subject to the guarantee
against hidden defects formulated in articles 1641 following French Civil Code.
A. Legal Guarantee of Conformity
Article L. 217-4 of the Consumer Code: The seller delivers goods in conformity with the contract
and is liable for any lack of conformity existing at the time of delivery. It is also responsible for
defects of conformity resulting from packaging, assembly instructions or installation when the latter
has been charged to it by the contract or has been carried out under its responsibility.
Article L. 217-5 of the Consumer Code: The good is in conformity with the contract: 1° If it is fit for
the use usually expected of a similar good and, where appropriate : - if it corresponds to the
description given by the seller and has the qualities that the seller has presented to the buyer in the
form of a sample or model; - if it has the qualities that a buyer can legitimately expect in view of the
public statements made by the seller, by the producer or by his representative, in particular in
advertising or labelling; 2° Or if it has the characteristics defined by mutual agreement between the
parties or is suitable for any special use sought by the buyer, brought to the seller's attention and
accepted by the latter.

Article L. 217-12 of the Consumer Code: The action resulting from the lack of conformity is time-
barred after two years from the delivery of the goods.

B. Warranty of defects of the thing sold
Article 1641 of the Civil Code: The Seller is bound by the warranty on account of the hidden
defects of the thing sold which make it unfit for the use for which it is intended, or which so diminish
this use that the buyer would not have acquired it, or would have given only a lower price, if he had

known them. Article 1648 of the Civil Code: The action resulting from redhibitory defects must be
brought by the purchaser within two years from the discovery of the defect.
When acting as a legal guarantee of conformity, the Customer :
- has a period of two years from the delivery of the good to act;
- may choose between repair or replacement of the goods, subject to the cost conditions provided
for in Article L.217-9 of the French Consumer Code;
- is exempt from having to provide proof of the existence of the lack of conformity of the goods
during the 24 months following delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may
have been granted.
The Customer may decide to implement the guarantee against hidden defects of the item sold
within the meaning of Article 1641 of the Civil Code and may in this case choose between
cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil
Code.
Article 10 - Applicable law :
The Customer fully accepts and acknowledges that French law governs these General Terms and
Conditions of Sale, as well as any dispute or litigation that may arise between the Customer and
the company YAZINA. In the event of a dispute, only French law and its courts shall be recognized
as competent to settle the dispute.
Protection of personal data
The personal data of the Clients are collected for the following purposes
Manage orders and their follow-up with the customer
Inform customers of commercial offers related to the brand
Strengthen and improve communication with the customer by sending personalized offers based
on the customer's preferences found on the site
B. Commercial offers and newsletters :
Moroccan Touch is likely to send customers information on commercial offers of the brand by mail,
email, sms, telephone or via all networks or web spaces.
By subscribing to our newsletter, you will receive information on current offers that may be of
interest to you.
You can unsubscribe to our newsletter at any time by clicking on the link provided for this purpose
on each of our newsletters.
The Customer has at any time the right to oppose without charge to these commercial prospecting
mailings, by clicking on the "unsubscribe" link included in each email or, by making the request to a
store or by email at the following address: moroccantouch.info@gmail.com.
C. Cookies
A cookie is a small file stored on your computer. It contains information on the navigation carried
out on the pages of our site. It makes it easier for the same person to use the site later on and to
take up the preferences chosen by a user during the visit. It is possible to limit the use of cookies
